Abstract [sv]

Kriminella kvinnor har genom historien i stort sett varit osynliga i forskningen. När de uppmärksammats har man traditionellt försökt finna förklaringar till det brottsliga beteendet i kvinnans biologiska och sociala faktorer som psykiskt mående eller bristande moral. I nutid uppmärksammas kvinnor i kriminologin men det finns fortfarande ett glapp i forskningen, trots att kvinnor inkluderas hamnar mannen i centrum. Syftet med studien har varit att undersöka om och i så fall hur synen på kvinnor som begår brott skiljer sig från män som begår brott. Samt om misstänkta kvinnor och misstänkta män behandlas på olika sätt i brottsutredningar och i så fall varför. Studien har genomförts med kvalitativa fokusgruppsintervjuer med olika funktioner inom rättsväsendet. Resultatet visar att det finns skillnader både i upptäckt av och synen på kvinnor som begår brott. Många av skillnaderna går att hänvisa till teorier om genus och konfirmeringsbias. Sammantaget leder det till att vi inte ser de kvinnor som begår brott. En viktig princip för rättssäkerheten är att du oavsett kön ska kunna lagföras och få rätt hjälp som brottsoffer. Med andra ord är jämställdhet mycket viktigt för rättssäkerheten.

Abstract [en]

Female offenders have historically been invisible in research. When they have been noticed, traditionally attempts have been made to find explanations for the criminal behavior in women's biological and social factors, such as mental well-being or lack of morality. Nowadays, attention is paid to women in criminology, but there is still a gap in the research, even though women are included, the man ends up in the center. The purpose of the study has been to examine whether, and if so, how the perception of women committing crimes differs from men committing crimes. Also, whether female suspects and male suspects are treated differently in criminal investigations and if so, why. The study has been conducted through qualitative focus group interviews with various roles within the judiciary. The result shows that there are differences both in the detection of and the perception of female offenders. Many of these differences can be referred to theories of gender and confirmation bias. Overall, this leads to women who commit crimes is not being seen. An important principle for legal certainty is that, regardless of your gender, you should be able to be prosecuted for a crime and receive the right help as a crime victim. In other words, gender equality is very important for legal certainty.
